joseph duncan, monster, stalked two little children for days. He bought night vision equipment at a local sports store. He broke into the house in the middle of the night and tied up the parens and another son. He took the two youngest out to his pickup and told them to stay there or he would kill their family. They stayed, probably frightened out of their minds. He went back in and beat the family to death with a hammer. He is in his thirties.

When he was 14, he raped another boy at knife point. He was incarcerated in a juvenile facility and his record sealed. He stayed there for 8 months and was released. When he was 16, he raped a boy at gun point and was arrested again. He is still a juvenile and was out by the time he was 17. All of his juvenile records were sealed. This is not a baby-faced sweet mixed-up kid. He was a monster then.

He then faced a string of arrest for the same type of crimes. When he came to Idaho, he was on a predator list in Nebraska. Incidentally he killed the little boy and the little girl was recognized in Denny's in Couer d Alene, Idaho, by a waitress or she would be dead, too.

He should have been tried in adult court the first time for the nature of his crime was violent and showed what kind of person he was.

I think when a criminal commits a violent crime on another person, he should be on lifetime probation or parole regardless of his age when he commits the crime. Those sweet children, and all the others he is now confessing to killing, are more important than his legal rights.

X-( I strongly disagree. Nate was not a habitual killer how could he be, this was his first ever murder. If it was habitual others would have been killed by him. He is also 11, he does no know fully what his consequences would be for his actions. Yes in his lifestyle and where he grew up he has probably seen more than I have at the age of 18. I believe he should have had a more severe punishment, but not charged as an adult. At his age he can be taught differently and learn what he did was wrong. He can be rehabilitated, the older someone is the more difficult it would be to change their ways. This is all I have to say. I also have a brother the same age and when my grandmother passed away a week ago, he didn't shed a tear. He wasn't very close to her and doesn't fully understand the idea that she isn't coming back. So maybe Nate didn't fully understand what he was doing meant this kid would never be around again.

Children are not dumb. I remember in 6th grade there was a group of boys in my school that were smoking, drinking, and doing drugs on a regular basis. Some lost their virginity by the 7th grade. These boys knew what they were doing.

Keep in mind, this was in a caucasian neighborhood and beautiful suburb southwest of Chicago.

Children's motives may be different than an adult's but they are still capable of commiting a terrible crime. A child might do it for popularity while an adult would do it for money... who knows? All I know is that I knew from a young age that I shouldn't steal, should hurt others, and shouldn't disrespect adults.

IMO too many kids are falling through the cracks of today's society! I know there are many factors that contribute, but I would like to address the fact that we knowingly and willingly bring these kids into this world. Therefore I believe that raising them should be much higher on our list of priorities. Children are neglected often at home because of marital and financial problems. Not acceptable IMO. Children are being neglected at school. Not acceptable IMO. So it blows me away that we think that these children who are not being guided and taught life skills by the adults we intrust to do so should serve adult sentences. Maybe we the adults should be raising these kids like parents used to, instead of just letting them grow up.
I know there are some children who are mentally ill and are capable of living an unremorseful criminal life, but intervention is available, even to these children if it is sought. However, the adult must be willing to observe the child's behaviour and seek out appropriate care without giving up.

This boy had several chances to comply and choose to buck the system every time he had a chance. He was not willing to listen to his mother and had no intention of be a useful member of society in the near future. He is still a problem after 7 yrs of constant rehab attempts and I believe he will be as much trouble when released as he was before. Had he have been a white boy he would have been charged with a hate crime and sent to adult prison.

What about the adults who are supposed to be guiding and protecting this child? Isn't it a parents responsibility to know what their children are doing? When I became a teenager my mother "tossed" my room weekly, monitored my phone privledges and made my business hers as often as she could.

I think we as adults should be able to tell if a young adult has meant to commit a crime no matter what his age. Nathaniel Abrahams random killing was thought out and done with intent. He had told his girl friend and was an habitual criminal. It was time for the justice system to treat him as an adult and put an end to his crime spree.

the kids told his girlfriend he was gonna shoot someone, that is premeditated murder on a human life. Yes he should be held accountable for his actions.

I also feel that children should be held accountable for their actions. Such as Nathaniel........he definitely was a "street kid"........such children grow up VERY fast and know more than a "regular" (for lack of another word)...child. "Street kids" are very knowledgeable in what they do...how they plan things....and what they will get away with and what they won't get away with. How old do Gangs start inducting these kids?....usually by age 9. Nathaniel was know to the police for 22 offenses although he hadn't been caught, they knew of him. You cannot tell me that he didn't know what he was doing at age 11. His own mother wanted help for him and placement in a Facility and that fell through the cracks.....so even she knew. I feel that he could be a very dangerous person when he gets out of Juvenile Detention....I do hope that he is getting the help he needs...but that does NOT always happen.

Children being tried as adults

Jan 4, 2006 3:56 PM
I feel that children should be made to pay for their actions. Unfortunately in today's world gangsters have gotten to where they use children to commit major crimes because kids normally do not get treated as adults. These kids know this and they agree to do things that they normally would not do because they know that they will not get in too much trouble. If they are treated as adults then they may think twice before they commit a major crime.
